Is it Worth it to Have a Trademarked Cocktail?
You're way more apt to find a trademarked alcohol brand than a cocktail, but cocktail trademarks do exist. Drinks like a Sazerac, Painkiller and a Dark 'n' Stormy are well-known cocktails that must be made with the designated spirits brands in the recipe to earn the right to the name.
While there is some "marketing genius" to trademarking a cocktail with your brand, is it worth it to enforce it? "People don’t realize the responsibility of having a trademarked drink," says Gary L. Rogalski, president/CEO of Pusser’s Rum, which owns the Painkiller trademark.
